These Terms & Conditions apply to all products and services offered by Kineticode B.V., trading as K/C Move, including the use of the website, booking platform, studios, classes, memberships, class cards, private training, duet sessions, workshops, events and other services.
By creating an account, purchasing a product, booking a class or using our facilities, you agree to these Terms & Conditions.
Kineticode B.V. is a private limited liability company incorporated under the laws of the Netherlands, having its corporate seat in Amsterdam and its office at Rozengracht 93A, 1016 LT Amsterdam, the Netherlands.
Kineticode B.V. is registered with the Dutch Chamber of Commerce under number 70370079.
In these Terms & Conditions, Kineticode B.V. is referred to as “K/C Move”, “we”, “us” or “our”.

In these Terms & Conditions, the following definitions apply:
Agreement means any agreement between K/C Move and a Client for the purchase or use of a Product or Service.
Booking Platform means the online platform used by K/C Move for bookings, accounts, payments and client administration, including but not limited to Bsport.
Class means any group class, private training session, duet session, workshop, event, assessment, training or other session offered by or on behalf of K/C Move.
Client means any person who creates an account, purchases a Product, books a Class, attends a Class or otherwise uses K/C Move’s services or facilities.
Credit means a booking right used to reserve or attend a Class.
K/C Move Studio means any studio or location operated by K/C Move, including the studios listed on kcmove.nl.
Membership means a recurring subscription giving access to K/C Move services according to the type of membership selected.
Parties means K/C Move and the Client together.
Product means any product or service offered by K/C Move, including Memberships, class cards, trial packs, introductory packages, private training, duet sessions, workshops, gift cards and corporate arrangements.
Website means kcmove.nl and related web pages operated by K/C Move.
These Terms & Conditions apply to all legal relationships between K/C Move and the Client.
Additional product-specific conditions may apply to certain Products, promotions, events, workshops, corporate agreements or private arrangements. If such conditions conflict with these Terms & Conditions, the specific written conditions for the relevant Product apply first.
Any deviation from these Terms & Conditions is valid only if agreed in writing by K/C Move.
K/C Move may amend these Terms & Conditions from time to time. The latest version published on the Website applies. For ongoing Memberships, K/C Move will inform Clients of material changes in advance where required by law.
To purchase Products or book Classes, the Client may need to create an account through the Booking Platform.
The Client is responsible for providing accurate and complete information and for keeping account details up to date.
Login details are personal and must be kept confidential. The Client is responsible for all activity carried out through their account.
K/C Move may refuse, suspend or terminate an account in case of misuse, fraud, non-payment, repeated breach of these Terms & Conditions or behaviour that K/C Move reasonably considers inappropriate or unsafe.
Current prices are published on the Website or in the Booking Platform.
All prices include VAT, unless expressly stated otherwise.
Products must be paid in advance, unless otherwise agreed in writing.
Payments may be processed through third-party payment providers or the Booking Platform. K/C Move does not store full payment card details.
K/C Move may change its prices and Products from time to time. Price changes do not affect Products already purchased, unless required by law or expressly stated otherwise.
Promotions, discounts and special offers are valid only under the stated conditions and during the stated period. They cannot be applied retroactively.
Memberships give access to K/C Move services according to the Membership type selected at the time of purchase.
Unless expressly stated otherwise, Memberships require an initial commitment period of six months. After the initial commitment period, the Membership continues month-to-month and may be cancelled with one full calendar month’s notice.
If a Membership is expressly offered as a flexible or month-to-month Membership, it may be cancelled with one full calendar month’s notice, unless a different lawful notice period is clearly stated at purchase.
During an initial commitment period, downgrading or cancelling the Membership is not possible, unless required by law or approved by K/C Move in writing. Upgrading to a higher Membership may be possible during the initial commitment period.
Memberships are personal and non-transferable.
Unlimited Memberships are subject to fair use. K/C Move may set reasonable limits on the number of daily bookings, waitlist priority, no-shows, late cancellations or other booking behaviour to ensure fair access for all Clients.
Membership fees are collected by recurring payment or direct debit, unless otherwise agreed. The Client must ensure that sufficient funds are available on the payment date.
If payment fails, K/C Move may suspend access to bookings and services until payment has been received. K/C Move may charge reasonable administrative or collection costs where permitted by law.
K/C Move may adjust Membership prices. If a price increase applies to an ongoing Membership, K/C Move will inform the Client in advance. Where required by law, the Client may terminate the Membership before the increase takes effect.
Class cards and packages are valid for the period stated at the time of purchase. Unused Credits expire automatically at the end of the validity period.
Unless expressly stated otherwise, class cards, packages and Credits are personal and non-transferable.
Introductory offers, including trial packs and first-step packages, are limited to one purchase per Client where stated.
The 30 Class Card / Share Card, where offered, may be shared by a maximum of two people and only under the conditions stated at purchase.
Expired Credits are not refunded. Extension of validity may be granted only at K/C Move’s discretion in exceptional circumstances, including serious illness, injury, pregnancy or extended absence. K/C Move may request reasonable supporting documentation before approving an extension.
The Client must book Classes in advance through the Booking Platform, unless otherwise agreed.
A booking is confirmed only when it appears in the Client’s account or when the Client has received confirmation from the Booking Platform or K/C Move.
K/C Move may refuse access to a Class if the Client does not have a valid booking, sufficient Credits, an active Membership or the required approval for the relevant Class.
The Client must arrive on time. Late arrival may result in refusal of entry for safety reasons and to avoid disturbing the Class. In such case, the booking may be treated as a late cancellation or no-show.
Group Classes must be cancelled at least 24 hours before the scheduled start time.
If a Client cancels a group Class less than 24 hours before the start time, or does not attend, the Credit may be charged or the booking may count as used.
Private training, duet sessions and assessments must be cancelled at least 24 hours before the scheduled appointment. If cancelled less than 24 hours before the appointment, the full session rate may be charged.
K/C Move may apply fair-use measures in case of repeated late cancellations or no-shows, including temporary booking restrictions.
K/C Move may cancel, reschedule or change a Class, teacher, timetable, location or format if necessary. If K/C Move cancels a Class, any charged Credit will be returned or a reasonable alternative will be offered.
If a Class is full, the Client may be able to join the waitlist through the Booking Platform.
If a place becomes available, the Client may be automatically added to the Class and notified by email, app notification or another available method.
The Client is responsible for monitoring their waitlist status. Once added to a Class, the normal cancellation and no-show policy applies.
For purchases made online or at a distance, consumers may have a statutory right to withdraw from the Agreement within 14 days without giving a reason.
The withdrawal period starts on the day after the Agreement is concluded.
To exercise the right of withdrawal, the Client must contact K/C Move at hello@kcmove.nl with a clear statement that they wish to withdraw from the purchase, including their name and purchase details.
If the Client requests or agrees that the service starts during the withdrawal period, and the Client uses the service during that period, K/C Move may charge a reasonable amount for the service already provided.
If the service has been fully performed within the withdrawal period with the Client’s prior express consent and acknowledgement that the right of withdrawal is lost once the service has been fully performed, the right of withdrawal may no longer apply.
This article does not limit any mandatory consumer rights.
K/C Move may, at its discretion, suspend, extend or adjust a Membership, class card or package in exceptional circumstances, including long-term illness, serious injury, pregnancy or relocation.
The Client must submit the request in writing and as soon as reasonably possible.
K/C Move may request reasonable supporting documentation, such as a doctor’s note or proof of relocation.
Suspension, extension or early termination is not automatic and requires written approval by K/C Move.
Participation in Classes and use of K/C Move facilities is at the Client’s own risk.
The Client is responsible for assessing whether they are physically able to participate in a Class.
The Client must inform the teacher before the Class of any injury, illness, pregnancy, medical condition or other limitation that may affect safe participation.
K/C Move services are not medical treatment and do not replace medical advice, diagnosis or care. Clients with medical concerns should consult a qualified healthcare professional before participating.
K/C Move may refuse participation or ask a Client to stop exercising if the teacher considers this necessary for health, safety or the proper execution of the Class.
The Client must follow all reasonable instructions given by K/C Move teachers, staff and representatives.
Clean sportswear is required. Shoes are not permitted in the Pilates or reformer areas unless K/C Move expressly allows them for a specific Class or training format.
Grip socks may be required for hygiene and safety reasons.
The Client must use equipment carefully and leave the space and equipment clean after use.
Smoking, drugs, alcohol abuse, disruptive behaviour, harassment, intimidation, offensive language and behaviour that affects the safety, privacy or enjoyment of others are not permitted.
Food and drinks are not permitted in training rooms, except water in a closed bottle.
Children and animals are not permitted in the studio unless K/C Move has given prior permission.
K/C Move may refuse access, cancel bookings or terminate a Membership immediately if a Client seriously or repeatedly breaches these rules.
The Client is responsible for their own belongings.
K/C Move is not liable for loss, theft or damage to personal belongings, except in case of intent or gross negligence by K/C Move.
K/C Move shall provide its services with reasonable care and skill.
To the maximum extent permitted by law, K/C Move is not liable for injury, loss or damage resulting from participation in Classes, use of facilities, failure to follow instructions, failure to disclose relevant health information, misuse of equipment or circumstances outside K/C Move’s reasonable control.
Nothing in these Terms & Conditions excludes liability where such exclusion is not permitted by law, including liability for intent, gross negligence or mandatory consumer rights.
The Client is liable for damage caused to K/C Move property, facilities or equipment if such damage results from negligence, misuse or intentional conduct by the Client.
K/C Move is not liable for failure or delay in providing services caused by circumstances outside its reasonable control, including but not limited to government measures, public health restrictions, fire, flooding, power failure, technical failure, strikes, transport disruption or other events of force majeure.
Where possible, K/C Move will offer reasonable alternatives, such as rescheduling, online services, Credit return or another appropriate solution, depending on the circumstances.
K/C Move may take photos or videos in the studio for internal, educational or promotional purposes only where appropriate and in accordance with applicable privacy law.
For clearly identifiable promotional photos or videos, K/C Move will ask for consent where required.
If the Client does not wish to appear in photos or videos, the Client should inform the teacher or K/C Move staff before the Class.
All intellectual property rights relating to K/C Move and KinetiCode® brands, concepts, methods, training materials, website content, text, images, videos, logos, designs, trademarks and other materials belong to K/C Move, Inessence Holding B.V. or their licensors.
The Client may use the Website and materials only for personal, non-commercial purposes.
The Client may not copy, reproduce, distribute, modify, publish, teach, sell, share, record or otherwise use K/C Move materials, methods, videos, images or content without prior written consent.
K/C Move aims to keep the Website accurate and up to date, but cannot guarantee that all information is always complete, current or error-free.
The Website may contain links to third-party websites, platforms or services. K/C Move is not responsible for the content, availability or practices of such third parties.
K/C Move processes personal data in accordance with its Privacy Policy, published on the Website.
Complaints may be submitted by email to hello@kcmove.nl.
The complaint should include the Client’s name, contact details, the relevant studio or service, the date and a clear description of the complaint.
K/C Move will aim to respond within 14 days. If more time is required, K/C Move will inform the Client.
Neither Party may assign its rights or obligations under an Agreement without the prior written consent of the other Party, unless otherwise permitted by law.
Failure by K/C Move to exercise any right does not constitute a waiver of that right.
If any provision of these Terms & Conditions is invalid or voided, the remaining provisions remain in force. The Parties shall replace the invalid provision with a valid provision that reflects the original intention as closely as possible.
These Terms & Conditions and any disputes arising under or relating to them shall be governed exclusively by Dutch law.
Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory consumer law provides otherwise.
